As of late, we have seen a large increase in requests to remove the "opt-out" functionality for club emails. While we understand that this creates extra work on your part as a registrar (having families opting to not receive email blasts) we would like to take a moment to explain why we will not be removing this option from families registering through our software.
Simply put, it's against the law to not provide this functionality. Any electronic message that does not contain both the ability to opt-out and a clear message of ability to unsubscribe contained within its message is in violation of the CAN-SPAM Act of 2003. Specifically, the CAN-SPAM Act of 2003 denotes its unsubscribe compliance as follows:
- A visible and operable unsubscribe mechanism is present in all emails.
- Consumer opt-out requests are honored within 10 days.
- Opt-out lists, also known as Suppression lists, are only used for compliance purposes.
While all of your emails may not be commercial in nature, we did notice a large influx of sponsored emails being sent through our system. Because of this, we were forced to introduce this functionality; as we explained in our previous MOTD, the major email providers take notice of SPAM markings and begin to blacklist our servers and place a blockade on emails sent to their users.
The obvious next question becomes "can you provide us with a list of users who have opted out?" The quick answer, no. As stated above, opt-out lists can only be used for compliance purposes. Creating a report, of any kind, listing out these users would directly violate CAN-SPAM.
Where do we go from here?
The AdminSports team is working diligently to provide a resource to our members to, separately, create and send sponsored emails which will still allow users the ability to opt-out and avoid unsolicited emails of a commercial nature. Once this tool is created, we will alter the ability for families to opt-out of club related email blasts and allow them to internally notify the AdminSports team of any emails violating CAN-SPAM.
